The Role of the Federal Courts: Umpires of Federalism

The Supreme Court has often intervened in the debate over the nature of federalism. In the case of McCulloch v. Maryland the court asserted the authority of the federal government over the states. Recent court cases indicate the Court may adopt a decentralist viewpoint.
